Changes to the Terms

Please review these Terms regularly as they may change at any time without notice. Using the Site after a change in these Terms constitutes your acceptance of any changes and you agree to follow and be bound by these Terms as changed.

Eligibility

By using the Site, you promise that you are either at least eighteen (18) years old, or if you are under eighteen (18)  years old that you are at least thirteen (13) years old and are accessing the Site with the full knowledge and consent of your parent or legal guardian, who will also be deemed to have agreed to these Terms by permitting you to access the Site.   You must be at least eighteen (18) years old, without exception, to create an Allmade.com account.

Account Registration

Certain parts of the Site may require registration or information to participate in certain features, such as Allmade’s mailing lists or ordering through Allmade’s secure online store.  Your decision to provide this information is at your sole option and discretion, but if you decide not to provide the requested information, you may not be able to participate in all features of the Site.  By providing information to the Site, you promise and agree that you will only provide true, accurate, current and complete information.

If you register on the Site in any way, you agree to accept responsibility for all of the activities that occur under your account or password, if any, and you agree that you will not sell, transfer or assign your Site account to any other person.  You are solely responsible for protecting the confidentiality of your password, if any, and for restricting access to your computer or any device that you choose to connect to, as applicable.  Allmade reserves the right to terminate your account or to deny you access in Allmade’s sole discretion without any notice or delay.

Intellectual Property

Unless otherwise noted, you should assume that everything you see, hear, or otherwise receive from or on the Site (the "Content") is copyright, trademark, trade dress or other intellectual property owned or licensed by Allmade Ventures, LLC (“Allmade”) and protected under U.S. and international laws and treaties. Content includes, without limitation, images, icons, graphics, text, photographs, videos, trademarks, logos, text, documents, sounds, the Site as a whole, and the selection, coordination and arrangement of Content.  You need express permission from Allmade to use Allmade and its associated logos, which are trademarks or service marks of Allmade. Use of trademarks in actual or altered domain names for apparel related sites is prohibited. Other trademarks used on the Site are the property of their respective owners.

Third Party Links and Content.

Any links from the Site to third party sites are provided only as a convenience. Your use of outside links is at your sole risk. Such links do not constitute Allmade’s endorsement of any third party, its site, or its goods or services. Allmade is not responsible for any outside sites, services or other materials linked to or from the Site and disclaims all liability for any injury you may experience by using such materials. If you have any concerns regarding any outside site linked to or from the Site, please direct them to the owner or operator of the outside site.

You may not create links to the Site that portray Allmade in a false or misleading light. You may not use any "framing" or similar techniques to enclose any portion of the Site. You may not link to any pages other than the Allmade.com homepage.

DISCLAIMERS AND LIMITATIONS OF LIABILITY

YOU USE THE SITE AT YOUR OWN RISK. TO THE FULLEST EXTENT ALLOWED BY LAW, ALLMADE MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND IN CONNECTION WITH THE SITE. ALLMADE PROVIDES THIS SITE, ALL CONTENT AND ALL INFORMATION AND PRODUCTS OR SERVICES OFFERED ON OR THROUGH THE SITE BY ALLMADE OR AS PROVIDED BY ANY THIRD PARTY, "AS IS." ALLMADE DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO ACCURACY, COMPLETENESS, IMPLIED WARRANTY OF MERCHANTABILITY, QUIET ENJOYMENT, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. 

ALLMADE WILL NOT BE LIABLE FOR ANY DAMAGES RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE, INCLUDING WITHOUT LIMITATION DIRECT, INDIRECT, SPECIAL, COMPENSATORY OR CONSEQUENTIAL DAMAGES, LOST PROFITS OR LOSS OF OR DAMAGE TO PROPERTY, EVEN IF ALLMADE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions may not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. Allmade does not warrant that your use of the Site, the operation of the Site, or any service offered on or through the Site, will be uninterrupted or error free, that defects will be corrected, or that the Site or its server are free of viruses or other harmful elements. Allmade makes no representations regarding the currency, accuracy or reliability of information on the Site.

Indemnification
You agree to assume full responsibility for any use of any information, goods or services, including any third-party services, offered on or through the Site. You understand and agree that Allmade will not be responsible or liable for any claim, loss or damage arising from the use of any information, goods or services.

You agree to defend, indemnify and hold harmless Allmade and its officers, directors, owners, agents, employees, affiliates, licensees and licensors from and against any and all claims, damages, costs and expenses, including reasonable attorneys' fees, arising from or related to your use of the Site or your violation of any of these Terms.

Applicable Law and Dispute Resolution

These Terms will be construed according to the laws of the State of Washington, U.S., without regard to its conflicts of laws principles. Any dispute arising under or relating to these Terms, the Content, the use of the Site, or any services obtained using the Site, shall be resolved by a court of competent jurisdiction located in King County, Washington. Your use of the Site constitutes your consent to submit to the jurisdiction and venue of the state and federal courts located in Washington State. In the event of a dispute hereunder, the prevailing party shall be entitled to recover its costs and expenses incurred, including reasonable attorneys' fees.

Submissions to Allmade

Allmade knows that you like to express yourself.  With the exception of any personal information you provide, which is subject to Allmade’s Privacy Policy, you agree that all comments, suggestions, ideas, reviews, feedback, and any original materials like  stories, drawings, artwork, designs, computer code, or merchandise, product  or marketing ideas and any other submissions sent, e-mailed, posted, disclosed, submitted or otherwise offered to Allmade on or through the Site or otherwise disclosed, submitted or offered by you to Allmade (collectively, "Submissions") shall belong and remain Allmade’s property.  Any communication or Submissions to Allmade by any means and your agreement to these Terms by using the Site shall constitute a complete assignment to Allmade of all universal rights, titles and interests in all copyrights and other intellectual properties in the Submissions.  That means that Allmade will exclusively own all such interests in the Submissions including rights, titles and the exclusive ability to use the Submissions in any way that Allmade decides, whether for commercial use or otherwise, and without limitation, including but not limited to publication, reproduction, performance, creation of derivative works, display and distribution.  You agree that Allmade will have no obligation to provide or pay any compensation, fees or royalties for any Submissions you make, or provide any attribution to you for providing any Submissions to Allmade.  The way Allmade uses Submissions is at Allmade’s sole discretion, if Allmade chooses to use them at all and Allmade has no obligation to review, return or keep Submissions private.  If you do not want to assign your Submissions to Allmade, do not send them to Allmade.  You promise that any Submissions made by you are your own and that those Submissions will not violate any intellectual property or other proprietary right(s) belonging to any third party.   You also promise and agree that your Submissions to Allmade will not be unlawful in any way or contain any libelous, abusive, inappropriate or otherwise obscene material or anything that would constitute or otherwise encourage any behavior that would be considered criminal or encourage conduct that is criminal. You alone are solely responsible for any and all of the content of the Submissions you make.  Allmade reserves the right to remove any user-submitted materials, without limitation, for any reason whatsoever.  Allmade also reserves the right to take any action that Allmade determines is reasonably necessary to correct or prevent a violation of these Terms.

MISCELLANEOUS

If a court of competent jurisdiction finds any provision or portion of these Terms to be void or unenforceable, that provision or portion will be enforced to the maximum extent permissible to affect the intent of these Terms, and the remainder of these Terms will remain in full force and effect. No waiver of any of these Terms shall be effective unless in writing and signed by both parties. No waiver of any past or present right arising from any breach or failure to perform shall be deemed to be a waiver of any future right arising under these Terms. These Terms are the entire agreement between you and Allmade relating to the Site. Any other agreement between you and Allmade regarding the subject matter of these Terms is superseded and has no force or effect. All rights not expressly granted herein are reserved.

ORDERING ALLMADE

Ordering 

You can place an order at any time through Allmade.com’s online store.  

Shipping

Allmade normally ships orders via UPS.  You pay all shipping and handling charges and have the choice between Standard and Expedited.  Please note that although Allmade ships orders received within 1-2 business days, holidays, weekends and other factors beyond Allmade’s control may increase estimated shipping times provided by UPS.

Returns

If you’re not completely satisfied with your purchase for any reason send it back.  Allmade.com will gladly accept any unworn, unwashed, unaltered or unused merchandise within 30 days of purchase.  Please email contact@allmade.com to start the return process. 

Payment 

Allmade currently accepts Visa and Mastercard credit cards.  Allmade.com’s secure server encrypts all submitted information so payment online with a credit card is safe and easy. 

Pricing & Availability   

All posted prices are subject to change without notice and are exclusive of applicable taxes and shipping and handling, which vary from state to state.  You are solely responsible for all sales taxes or charges. Merchandise is subject to change or withdrawal, or may be temporarily or permanently out of stock. If merchandise becomes unavailable, Allmade.com may cancel your order.

Damaged or Incorrect Items

Allmade is committed to quality, but recognizes that sometimes mistakes happen or a product may be damaged.  If you receive the incorrect item or a product that is damaged, Allmade is happy to exchange it or replace it free of charge.  Please contact Allmade at contact@allmade.com and an Allmade representative will work with you to resolve the issue.

Export Shipments  

Allmade is currently only available for sale in the United States, including Puerto Rico, Guam and the Virgin Islands.  All other sales are expressly prohibited.
